GUARDIAN AGREEMENT

This Agreement, dated the ________ day of _____________, 20_____ is between Llewellyn’s Grove Labradoodles (“Breeder”) and _______________________________ (“Guardian”) concerning the guardianship of _______________________, sired by ___________________. The Dog’s color is ____________________________ and the date of birth is ____________________. Microchip number is noted above.

 

WHEREAS, Breeder, engaged in the business of breeding Labradoodles, owns and wishes to place the Dog into the guardianship care of Guardian, who will be acting as a foster parent to provide physical care to and supervision of the Dog, subject to the terms of this Agreement; and

 

WHEREAS, the Dog is potential breeding stock, and is to be used as breeding stock exclusively by Breeder;

 

NOW, THEREFORE, in consideration of the mutual promises set forth herein, intending to be legally bound thereby, the parties hereto agree as follows:

 

The deposit for this dog is $500.00 up front. Llewellyn’s Grove Labradoodles intends to use this dog as a breeding dog, provided that he/she passes all health testing (determined by the breeder) and continues to grow and develop into a dog that is deemed suitable for our breeding program. If Llewellyn’s Grove Labradoodles makes the decision not to breed this dog, then the dog must be neutered/spayed immediately. Ownership of the dog will be turned over to the Guardian once proof of neuter/spay has been given to Llewellyn’s Grove Labradoodles and the $500.00 deposit will be returned.

 

Should Llewellyn’s Grove Labradoodles determine that the dog will be bred, the initial deposit will be refunded to the Guardian with the following schedule:

 

1. This deposit will be refunded the first time the dog produces a litter provided the dog is trained and has earned its Canine Good Citizen title. The Guardian has up to one (1) year from the signing of this document to train the canine adequately to earn the Canine Good Citizen title.


 

  1. Defined Terms. The words and phrases used in this Agreement shall have their usual and customary meaning unless specifically defined. In addition to those capitalized terms defined herein, the following terms have the meanings set forth below:

    1. “Estimated Value” of the Dog means $10,000.00

    2. “Guardian” or “Guardian Family” means the person or persons overseeing the physical care, supervision, grooming and training of the Dog.

    3. “Sick visits” means visits to a veterinarian occasioned by illness or injury to the Dog.

  2. Ownership; Possession. 

    1. Ownership, and all rights, title, and interest to the Dog, shall remain with the Breeder until such time that a written transfer of ownership is provided to the Guardian.

    2. Any puppies whelped by the Dog shall be the sole property of the Breeder, and Guardian shall have no ownership interest in or right to possession of any such puppies.

    3. At such time as Breeder decides not to breed the Dog, the Breeder shall notify the Guardian who must arrange to have the Dog spayed/neutered as soon as reasonably possible. Breeder will pay the cost of spaying/neutering provided an approved veterinarian performs the procedure. Ownership of the Dog will then be transferred to the Guardian upon delivery to the Breeder of proof of spaying/neutering.

    4. Upon the execution of this Agreement, Breeder will transfer possession of the Dog to the Guardian. Guardian shall retain possession of the Dog and shall provide physical care to and supervision of the Dog, subject to the terms and conditions of this Agreement.

  3. Breeding.

    1. Breeder intends to use the Dog as a breeding dog, provided the Dog passes all health testing, as determined by Breeder and veterinarian, and continues to grow and develop into a dog deemed suitable for our breeding program.

    2. Under NO circumstances is the Dog to be bred by anyone other than the Breeder.

    3. Breeder retains the right to determine when and how many times the Dog is bred for potential litters. The Guardian will make the Dog available to Breeder when needed, as reasonably determined by Breeder, and will notify the breeder during times of absence for travel and vacations.

    4. Notwithstanding the foregoing, if the Dog is female, Breeder agrees the Dog will not be bred more than four (4) times without the consent of Guardian.

  4. Breeder’s Obligations. During the time the Dog remains in the possession of the Guardian and during the term of this Agreement, Breeder shall:

    1. Provide Guardian with nutritional and dietary guidelines for the Dog.

    2. Approve a veterinarian to provide veterinary care for the Dog. Rocky Gorge Animal Hospital may be used without prior approval. Please contact us for approval if you wish to use another veterinarian.

    3. At the time for breeding, take possession of the Dog from Guardian, and provide care to and supervision of the Dog until the breeding process is completed, at which time the dog will be returned to the possession of the Guardian.

    4. Pay for all veterinary expenses and health testing associated with the breeding of the Dog.

    5. The Breeder may visit the Guardian’s residence upon reasonable notice, to observe the Dog’s environment and discuss with Guardian any and all issues concerning the care of supervision of the Dog.

    6. Upon request, provide instruction and guidance on grooming needs of the Dog.

  5. Guardian’s Obligations. During the time the Dog remains in the possession of the Guardian, and during the term of this Agreement, Guardian shall:

    1. Safely confine the dog by using a traditional fence, or electronic fence (such as Pet Safe/Invisible style fencing and maintain it in working order) or other methods of confinement mutually agreed to and specified here.

    2. Provide supervised restraint with use of a leach at all times when the dog is off property.

    3. Provide adequate exercise for the dog on a daily basis.

    4. Comply with Breeder’s nutritional and dietary guidelines and pay all costs and expenses associated with feeding the dog:

      1. Life’s Abundance Dog foods are to be fed and ordered under us as the field agent. They can be purchased at www.lifesabundance.com; our account number is 20733049. Please let us know if you have difficulty in setting up your online purchases.

      2. Fish oil is to be given to said Dog daily. Acceptable brands are Life’s Abundance, Bravo, or Grizzly. These brands are the only brands that test their oils for toxins as well as using wild caught (not farmed) fish, and are the only brands acceptable.

      3. Berte’s Immune blend (b-naturals.com) is to be sprinkled daily on food as a daily supplement.

      4. Schedule and pay for all veterinary appointments (other than those associated with breeding, which will be covered by Breeder), and provide routine medical care, including heartworm medication and tick and flea prevention appropriate for a breeding. Only Front Line flea and tick prevention (or other suitable topical product) is allowed to be used on our breeding dogs. NO ORAL FLEA AND TICK MEDICATIONS ARE EVER TO BE USED ON OUR DOGS. Please note that veterinarians and other literature claim that these other preventatives are deemed safe, even during pregnancy, but several breeders have lost dogs and even entire litters due to using them. DO NOT MAKE SUBSTITUTIONS. If you feel that Front Line is not working, please contact us first, not your veterinarian.

      5. Use the services of the agreed upon veterinarian unless a situation dictates otherwise.

      6. Notify Breeder of scheduled vacations or other absences from the area which may occur. Make certain that the dog is available/accessible for breeding purposes at all times.

      7. Maintain a principal place of residence with a 30 minute radius of Laurel, MD, and notify the Breeder of any change of address, telephone numbers, or email address.

      8. Maintain the Dog’s coat to ensure the Dog is properly groomed and free of excessive matting.

      9. Provide a tick free environment to the best of their abilities, keeping the area that the Dog has daily access to free from brush, tall grass, and excessive leaves that can harbor tick infestations and disease.

      10. Fully train the Dog and obtain a Canine Good Citizen award by the time the Dog is one year old.

  6. Removal Of Dog. The Breeder may permanently remove the Dog from the possession of Guardian if Guardian does not comply with the terms of this Agreement, or if anything else arises not specifically addressed in this Agreement which puts the Dog in danger, at health risk, or limits availability to the Breeder. Breeder agrees to consult with the Guardian before permanently removing the Dog from Guardian’s possession unless, in the judgement of the Breeder, the health, welfare and safety of the Dog requires immediate removal. If the Dog does not need immediate removal, Breeder shall give Guardian a reasonable amount of time to comply with Breeder’s requirements for maintaining the health, welfare, or safety of the Dog before permanently removing the Dog from Guardian’s possession.

  7. Termination of Agreement. This Agreement shall terminate, and neither party shall have any further obligation to the other party upon the occurrence of any of the following:

    1. Death of the Dog from natural or accidental causes;

    2. Permanent return of the Dog by the Guardian or permanent removal of the Dog from the Guardian;

    3. Transfer of ownership of the Dog to the Guardian pursuant to Section 2.c hereof.

  8. Indemnity. Guardian agrees to indemnify and hold harmless the Breeder from and against all claims, liabilities, losses, costs, damages, and expenses by reason of any damage to property or injury or death to individuals allegedly caused by the Dog while in the possession of Guardian.

  9. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland.

 

IN WITNESS WHEREOF, and intending to be legally bound, the parties have executed this Agreement on the date set forth above.
